The Ipoh High Court awarded RM155,000 to a hospital staff member and her husband, ruling the hospital negligent for failing to conduct a mandatory pregnancy risk assessment, which led to a 2018 miscarriage. Judicial commissioner Moses Susayan found the hospital's failure to ensure a safe working environment for pregnant staff directly caused the loss. The court noted the hospital didn't perform a risk assessment and instead asked the employee for a written request for light duties. The couple was also awarded RM40,000 in costs. The lawsuit cited violations of Malaysia's Occupational Safety and Health Act and common law negligence. The employee claimed an "overburdened workload" during her pregnancy due to a lack of a co-worker.
