Demoted Suhakam Officer Files Judicial Review for Reinstatement and Damages

Alfonso Min, a Suhakam officer, has filed for a judicial review to challenge his demotion from Grade 48 to Grade 41 in August 2024, which he claims was done without due process and resulted in a pay cut. He is seeking reinstatement as principal assistant secretary with full seniority and benefits, a declaration that disciplinary proceedings against him are null and void, and compensation for lost salary, allowances, and statutory contributions.

Min, based in Kota Kinabalu, denies allegations of underperformance, asserting he consistently fulfilled his duties. He also disputes the assessment process, claiming it was conducted improperly. After his demotion, Min, who joined Suhakam in 2013, stated he was ordered to repay a portion of his salary and had his appeals rejected multiple times.

Min filed his application on July 23 at the Kota Kinabalu High Court, naming Suhakam and its disciplinary committee as respondents. He alleges Suhakam acted in bad faith regarding his 2023 performance evaluation, and that his demotion and salary withholding since September 2024 are unlawful breaches of contract, causing hardship and reputational harm. The case is scheduled for September 8. Min expressed that the situation has been deeply hurtful, stating he is seeking accountability and fair treatment for all Suhakam officers.
